Now I am not sure whether or not TLN has anything trademarked or copyrighted or anything along those lines, but I do know that what happened here was that Boss Nasti recorded the stream from the 4 team lan. Obviously you have to pay to watch the lan's, and what happened here is that he is allowing people to watch it for free on YouTube. This could be a non-issue, but I just wanted to bring it to an admin's attention.

I'm not a lawyer but it would seem to me that the terms of service provided prohibit this here.

This license does not include the right to: (a) use the Service or Materials for other than for its intended purpose, including but not limited to any marketing, selling, or other commercial uses(c) publish, publicly perform or display, or distribute to any third party any Materials, including reproduction or hosting the Materials on any computer network or broadcast or publications media;

Unless there is expressed consent from Mr P for its use: I really do hope that Mr P or Towey (or whoever runs TLN's YouTube account) files copyright claims on both these videos. In my opinion, this should also include a ban from using any part of TLN what-so-ever. I could write more, but don't feel like getting too mad right now...

Yeah I guess he should it down. It could just be a simple mistake.

However I don't agree with people saying that he is a joke. He can nearly always pick up on why a person dies etc. In the LAN alot of the time Instinct were just pushing randomly and not together. They really didn't have any good teamwork. An example would be someone would call out one shot and a teammate would run half way round the map trying to get to it while paying to attention to the other guys on the map which usually ended in the one shot staying alive while the instinct teammate got killed.

I know some of you don't agree with what he is saying and stuff like that, and I am not saying that I agree with what he is saying, but that is a different issue. The issue here is the legal stuff. So I'm certaintly not yelling at you or anything, I am just asking that we try to stick to the facts of the matter.

This is why a Company like Machinima has to pay Activision a Copyright Fee to upload Call of Duty gameplay because they make so much money off of it. TLN doesn't even have the right to come after me because it's not their copyright for the gameplay, it's Activisions. Also since I'm not going around saying that I'm apart of TLN or anything of that sort or trying to pass it off as my own then there is no legal action that they could take either.

Even MLG has to pay Bungie to stream & for other things just to use Reach on the circuit. There's a whole legal world that the majority of you know nothing about, so you shouldn't form an opinion based off something you have an insufficient amount of knowledge in.

On top of all this is anything I'm just promoting for them. So why would they even thing of doing anything to me, they would just be losing a source of Advertisement for them. Some of you should honestly try thinking & using your brains once & a while before you open your mouths.

p.s.- The only way that I would be breaking any legal terms of service with TLN would be if I recorded anything but gameplay from them. Then this would apply.

The reply video to the reply video of THIS video is FAR better. I hate to add any unproductive comments to a thread that has already made its point, but this guy has to be the worlds best Troll. It bothers me that I can't tell if he is the most sarcastic person in existence or simply delusional.

Boss Nasti, your defense is weak because ultimately you took a paid "Premium" access only service and posted it for free in a public form. How is this NOT a viable excuse to BAN you from this site? If TLN as a site allowed any premium member to capture and post their premium content for free elsewhere it potentially deters other users from paying for access to this content. BOSSNASTi does bring up some good points, he is able to use game play footage as outlined in Microsoft's Game Content Usage Rules, and therefore is not infringing on TLN's copyrights unless TLN has it's own license with Microsoft that defines copyright ownership of videos/streams they have recorded (doubt that)...which begs the question, does TLN have a license agreement with Microsoft that allows them to sell a subscription for game play footage of Reach? If not, and seeing that it's specifically prohibited by Microsoft's Game Content Usage Rules, TLN could be heading towards some copyright lawsuits of their own.

What it boils down to is that BOSSNASTi is providing free TLN advertisement to his 2k+ subscribers. Does Mr. P really want to lose that kind of exposure?
